PAYMENT TERMS & CONDITIONS
Please read these Terms and Conditions carefully before engaging in any business transaction with Benjamin Raymond. These Terms and Conditions govern the payment terms for services provided by Benjamin Raymond. By making a payment, you agree to be bound by these Terms and Conditions.
1. Payment Structure:
a. 65% Payment Upfront: Upon agreement of the project scope and quotation, the client shall make a non-refundable payment of 65% of the total project cost before any work commences.
b. 35% Payment Upon Completion: The remaining 35% of the total project cost shall be paid by the client upon completion of the work. Once payment has been received, all works will be released from our studio.
*If working abroad, the final 35% is paid when work commences on site.
2. Payment Methods:
a. Upfront Payment: The client shall make the upfront payment through a mutually agreed-upon payment method, such as bank transfer, credit card, or any other method approved by Benjamin Raymond.
b. Payment Upon Completion: The client shall make the final payment through the same payment method used for the upfront payment.
3. Work Completion:
a. Benjamin Raymond will notify the client upon completion of the work and provide relevant documentation or evidence to support the completion.
b. The client shall have a reasonable period, not exceeding 7 days from the date of notification, to inspect and approve the completed work.
4. Delivery:
a. The completed work shall remain with Benjamin Raymond until the final payment is received.
b. Upon receipt of the final payment, Benjamin Raymond will release the completed work to the client or arrange for its delivery as agreed upon.
5. Late Payment:
a. In the event of late payment, Benjamin Raymond reserves the right to charge interest on the outstanding amount at a rate of 1% per month or the maximum rate permitted by law, whichever is lower.
b. Benjamin Raymond may also suspend work or withhold delivery until the outstanding payment is received.
6. Cancellation or Termination:
a. If the client cancels the project after making the upfront payment, the client forfeits the upfront payment made.
b. If Benjamin Raymond is unable to complete the work due to unforeseen circumstances or any other valid reason, the upfront payment will be refunded to the client.
7. Disputes:
a. Any disputes arising from these payment terms shall be resolved through negotiation and mutual agreement between the client and Benjamin Raymond.
b. If a resolution cannot be reached, both parties agree to submit to the exclusive jurisdiction of the courts in UK or the UAE.
By making the upfront payment, you acknowledge that you have read, understood, and agreed to these Terms and Conditions. These Terms and Conditions may be subject to change, and any updates will be communicated to you in writing.
DESIGN AGREEMENT & SIGN OFF
Please read these Terms and Conditions carefully before engaging in any design project with Benjamin Raymond. These Terms and Conditions govern the sign-off process for designs and acknowledge the possibility of variations due to the handmade nature of our work. By signing off on designs and engaging in our services, you agree to be bound by these Terms and Conditions.
1. Design Sign-Off:
a. The client acknowledges that all design concepts, drafts, and final designs will be presented for review and sign-off before any work commences.
b. The client agrees to carefully review and provide feedback on the designs within a reasonable timeframe, as specified by Benjamin Raymond.
c. Once the client has signed off on the designs, any changes or modifications requested thereafter may incur additional charges and may impact the project timeline.
2. Acknowledgment of Variations:
a. The client understands and accepts that due to the handmade nature of our work, there may be slight variations in the final product compared to the approved designs.
b. These variations may include, but are not limited to, colour shades, texture, pattern placement, and minor design details.
c. Benjamin Raymond will make every effort to ensure that the final product closely matches the approved designs, but the client acknowledges that some variations are inherent in the handmade process.
3. Consultation/Sample Agreement:
a. The client agrees to sign and submit any consultation or sample agreement forms provided by Benjamin Raymond before any work commences.
b. These forms may include details of the design requirements, specifications, materials, and any other relevant information necessary for the project.
c. Failure to sign and submit the required forms may result in delays or cancellation of the project.
4. Payment and Ownership:
a. The client acknowledges that all designs, concepts, and intellectual property created by Benjamin Raymond remain the sole property of Benjamin Raymond until full payment is received.
b. Upon receipt of full payment, the client will have the right to use the approved designs for the agreed-upon purpose.
5. Cancellation or Termination:
a. If the client cancels the project after signing off on the designs, any payments made up to that point are non-refundable.
b. Benjamin Raymond reserves the right to terminate the project if the client fails to provide timely feedback, sign-off on designs, or fulfil their obligations as outlined in these Terms and Conditions.
6. Disputes:
a. Any disputes arising from the design sign-off process or variations in the final product shall be resolved through negotiation and mutual agreement between the client and Benjamin Raymond.
b. If a resolution cannot be reached, both parties agree to submit to the exclusive jurisdiction of the courts in UK or the UAE.
By signing off on the designs and engaging in our services, you acknowledge that you have read, understood, and agreed to these Terms and Conditions. These Terms and Conditions may be subject to change, and any updates will be communicated to you in writing.
EXCLUSIVE RIGHTS TO PHOTOGRAPHY
a. The client acknowledges and agrees that Benjamin Raymond shall have exclusive rights to use any photography taken in which our designs are featured.
b. This includes, but is not limited to, the use of such photography for promotional materials, marketing campaigns, social media, website content, and any other purposes deemed appropriate by Benjamin Raymond.
c. Benjamin Raymond may use the photography in both digital and print formats, without any further consent or compensation required from the client.
d. The client grants Benjamin Raymond a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, translate, distribute, and display the photography in any media or platform now known or hereafter developed.
By signing off on the designs and engaging in our services, you acknowledge and agree to grant Benjamin Raymond exclusive rights to use any photography taken in which our designs are featured, as outlined in this section.
GUARANTEE
Please read these Terms and Conditions carefully before purchasing any product from Benjamin Raymond. These Terms and Conditions govern the 5-year guarantee provided by Benjamin Raymond. By purchasing our product, you agree to be bound by these Terms and Conditions.
1. Guarantee Coverage:
a.Benjamin Raymond guarantees that the purchased product will be free from defects in materials and workmanship for a period of 5 years from the date of purchase.
b. This guarantee covers any manufacturing defects that may arise during normal use of the product.
2. Exclusions:
a. This guarantee does not cover any damages caused by third parties, including but not limited to improper handling, misuse, negligence, accidents, or unauthorised repairs or modifications.
b. Any damages resulting from work carried out by others, such as installation, maintenance, or repairs performed by individuals or entities not authorised by Benjamin Raymond, are not covered by this guarantee.
3. Claim Process:
a. To make a claim under this guarantee, the customer must provide proof of purchase, such as a valid receipt or invoice.
b. The customer must notify Benjamin Raymond in writing within 30 days of discovering the defect and provide a detailed description of the issue.
c. Benjamin Raymond reserves the right to inspect the product and assess the validity of the claim before taking any action.
4. Remedies:
a. If a valid claim is made within the guarantee period, Benjamin Raymond will, at its discretion, either repair or replace the defective product or provide a refund for the original purchase price.
b. The repaired or replaced product or refund will be the sole remedy available under this guarantee.
5. Limitations of Liability:
a. Benjamin Raymond shall not be liable for any indirect, incidental, special, or consequential damages arising from the use or inability to use the product, even if advised of the possibility of such damages.
b. Benjamin Raymond's liability under this guarantee is limited to the repair, replacement, or refund as stated in section 4.
6. Transferability:
a. This guarantee is non-transferable and applies only to the original purchaser of the product.
7. Governing Law:
a. These Terms and Conditions shall be governed by and construed in accordance with the laws of UK or the UAE
b. Any disputes arising from these guarantee terms shall be resolved through negotiation and mutual agreement between the customer and Benjamin Raymond.
c. If a resolution cannot be reached, both parties agree to submit to the exclusive jurisdiction of the courts in the UK or the UAE.
